Disclaimer and Engagement of Services

1. Definitions

For the purposes of this policy:

  • The Organisation refers to the individual, company, agency, or third party responsible for hosting, promoting, coordinating, or managing an event, training, or workshop.

  • The Facilitator refers to Malinda Guest, the author, creator, developer, presenter, and owner of Let’s Talk TACTICS, Know Your Mates, and all associated intellectual property.

  • The Participant refers to any person attending, viewing, or engaging with a workshop, presentation, training, or related event delivered by the Facilitator.

  • The Public refers to any other person or entity accessing Let’s Talk TACTICS or Know Your Matesmaterials, resources, or website content outside of a contracted event or program.

2. General Disclaimer

The information contained in the Facilitator’s workshops, presentations, conferences, programs, resources, slides, and materials is provided as general guidance only and should not be relied upon as a substitute for professional judgment.

It is not intended to replace professional advice, diagnosis, or treatment. These materials do not replace formal risk assessment, clinical decision-making, or organisational policies and procedures.

Participants and Organisations are encouraged to consider the specific context, consult relevant guidelines, and seek appropriate professional advice when managing risk to ensure the safety and wellbeing of all involved.

3. Intellectual Property Ownership

Let’s Talk TACTICS (also known as TACTICS), Know Your Mates cards, and all associated materials, frameworks, tools, and resources have been developed exclusively by the Facilitator and are fully protected under Australian copyright law.

The Facilitator retains full rights and ownership of these programs, along with all related intellectual property, including but not limited to written content, visual resources, slides, training materials, and educational products.

Where contributions from others have informed the content, they have been appropriately acknowledged.

4. Copyright and Reproduction

All Organisations, Participants, and Members of the Public accessing Let’s Talk TACTICS, Know Your Mates, or other materials created by the Facilitator are subject to the following conditions.

No Organisation, Participant, or Member of the Public has permission to reproduce, share, record, distribute, adapt, publish, or profit from any part of this material without the express written consent of the Facilitator.

All workshops, presentations, and resources—whether delivered in person, online, or through digital formats—must not be recorded, captured, or shared in any form without explicit written permission.

This includes but is not limited to:

  • Copying or redistributing slides, notes, or handouts;

  • Recording live sessions (audio or video);

  • Using excerpts or screenshots in marketing, training, or online content; and

  • Uploading materials to internal or public online platforms.

Any unauthorised use may constitute a breach of copyright and intellectual property law under the Copyright Act 1968 (Cth).

5. Artificial Intelligence (AI) and Recording Restrictions

Participants and Organisations are not permitted to use artificial intelligence (AI) tools to record, transcribe, summarise, or reproduce any part of any session or material.
The use of AI technologies or recording devices for capturing, storing, or processing session content is strictly prohibited.

6. Data Collection and Evaluation

Any program evaluation or data collection undertaken by the Facilitator is conducted solely for quality improvement and program evaluation purposes.
All data is de-identified, securely stored, and used exclusively to improve program design and outcomes.
No personal or sensitive information is shared, sold, or disclosed to third parties.

7. Relationship Between Let’s Talk TACTICS and Boundless Psychology

The Facilitator is also the Director of Boundless Psychology Pty Ltd, which operates as a separate legal entity from Let’s Talk TACTICS.
Each entity is governed by its own policies, procedures, and privacy frameworks.

No personal, client, or participant information is ever shared between Boundless Psychology and Let’s Talk TACTICS.

8. Email Communication

Email is not a secure medium for transmitting confidential information. Email accounts are not monitored 24 hours a day, and messages are not reviewed on weekends. For urgent or sensitive matters, contact should be made by phone during business hours.

If an email is received in error, the recipient must notify the sender immediately and delete the message. The contents must not be reproduced, forwarded, or disclosed to any other party.

9. Payment Terms

Payment for services must be made within 7 days of the completed session or delivery date, unless otherwise agreed in writing.
Late payments may result in the suspension of future services until the outstanding balance is settled.

10. Cancellation Policy

Organisation Cancellations

  • Cancellations made 14 days or more prior to the scheduled session will incur no charge, or a full refund will be issued if payment has already been made.

  • Cancellations made within 7–13 days of the session will incur 50% of the session fee, or a 50% refund will be issued if payment has already been made.

  • Cancellations within 7 days of the session, or non-attendance without notice, may incur the full session fee, unless exceptional circumstances apply.

Facilitator Cancellations

  • Cancellations made by the Facilitator due to unforeseen circumstances (such as illness, emergencies, or natural disasters) will result in a full refund or no charge.

  • If the scheduled session was to be held in person, a virtual delivery option (via video platform) may be offered where appropriate and feasible.

  • The Organisation will be notified as soon as possible of any changes or alternative arrangements.

All cancellation and transfer requests must be made in writing to reception@boundlesspsychology.com.au.

11. Cookies and Website Data

The Let’s Talk TACTICS website (https://lets-talk-tactics.com) uses cookies to enhance functionality and track usage statistics.
Cookies do not identify users personally but assist in improving user experience and website performance.
Cookies can be disabled in browser settings; however, some website features may not function properly as a result.

12. Social Media Policy

The Facilitator maintains a professional presence on social media platforms for educational, awareness, and community engagement purposes.

Organisations and Participants are asked to:

  • Refrain from posting, recording, or sharing workshop content, slides, or participant discussions on social media without written consent from the Facilitator.

  • Engage respectfully and maintain confidentiality when commenting or interacting on public platforms.

  • Understand that all content shared by the Facilitator on social media is provided for informational and awareness purposes only and does not constitute professional advice.

Any unauthorised use, reproduction, or distribution of materials from Let’s Talk TACTICS, Know Your Mates, or any other resources created by the Facilitator on social media is prohibited and may infringe copyright.

13. Consent to Terms

By engaging with services, attending workshops, or accessing any content created or delivered by the Facilitator, you consent to the terms of this Disclaimer and Engagement of Services, and acknowledge that these terms may be updated from time to time.
